Company Privacy Policy

This policy outlines how we use and process personal data from client Schools, Academies, Multi Academy Trusts and Local Authorities. Sol Attendance Limited aims to ensure that all personal data is collected, stored and processed in accordance with the General Data Protection Regulation (GDPR) and the expected provisions of the Data Protection Act 2018 (DPA 2018) as set out in the Data Protection Bill.

The categories of this information that we collect, process, hold and share include:

  • Client name and job title
  • Client contact information including email address
  • Student name, year group and tutor group and, if relevant, house group
  • Student attendance information (sessions attended, number of absences and absence reasons)
  • School, Academy, Multi Academy Trust attendance statistics
  • Student characteristics (gender, SEN, FSM, PPG, LAC, EAL status, ethnicity and enrolment status)
  • Consultant personal data including name, address, date of birth, qualifications, experience, Single Central Record information including DBS, band details

Why we collect and use this information

We require this information to understand your needs and provide you with a service to support improvement.

We use children and young person's data to:

  • enable us to carry out specific functions for which we are responsible
  • to support the learning of your children and young persons
  • enable us to build the client Sol Attendance Tracker
  • derive statistics which inform improvement recommendations
  • support you in assessing performance
  • assess the quality of our services

We use consultant data to:

  • enable us to carry out specific functions for which we are responsible
  • provide clients with information regarding skills and experience
  • ensure safeguarding requirements are met
  • enable payment for work completed

The lawful basis on which we use this information

We will collect and process data for the following lawful reasons:

  • The data needs to be processed so that the company can fulfil a contract with an individual client school, academy or Multi Academy Trust, or the client has asked the company to take specific steps before entering into a contract.
  • The data needs to be processed for the legitimate interests of the company or a third party (provided the individual's rights and freedoms are not overridden)

For special categories of personal data, we will also meet one of the special category conditions for processing which are set out in the GDPR and Data Protection Act 2018.

We will process special category data for the following lawful reasons:

  • The data subject has given explicit consent to the processing of personal data for one or more specified purposes.

Collecting Information

The information you provide is supplied to us on a voluntary basis as part of our contract of work with you. Individuals also have the right to withdraw their consent to processing at any time.

Storing Information

We hold children and young person's data for the duration of the contract agreed. Data is stored securely and deleted after the completion of the contract.

Consultant data is held securely whilst completing projects for Sol Attendance Limited.

Sharing Information

We do not share any children or young person's data with anyone outside of the company without consent, unless the law allows us to do so. All consultant training materials are anonymised.

If an academy is part of a Multi Academy Trust we will share individual academy attendance statistics with the Trust.

Why we share this information

In case of academies which are part of a Multi Academy Trust we share attendance statistics to enable clients to:

  • ensure we are completing specific functions for which we are responsible
  • support clients in assessing performance
  • assess value for money

Requesting access to your personal data

Under data protection legislation, parents and pupils have the right to request access to information about them that we hold. To make a request for your personal information contact the Sol Attendance Limited Data Protection Officer.

You also have the right to:

  • object to processing of personal data that is likely to cause, or is causing, damage or distress
  • prevent processing for the purpose of direct marketing
  • object to decisions being taken by automated means
  • in certain circumstances, have inaccurate personal data rectified, blocked, erased or destroyed; and
  • claim compensation for damages caused by a breach of the Data Protection regulations.
